The level 44's appear to have a hidden "playthrough" attribute assigned to them; I've picked up some level 44 artifacts during other people's games, and couldn't equip them on my playthrough 2.5 character - yet, level 44 artifacts picked up in my own playthrough 2.5 game could definitely be used (and raised the relevant elemental to level 6).
